Breathalyzers are like any other machine – they must be maintained, routinely calibrated, and checked for accuracy. More often than people realize, however, Breathalyzers provide inaccurate results because they are improperly maintained or calibrated incorrectly. Blood tests, on the other hand, must be administered according to a set protocol by an authorized person, leaving room for error if the sample is not handled appropriately. Additionally, blood test sample kits contain preservatives in their vacuum tube which can taint a sample if present in too great or too small of a quantity.

Breathalyzers

A Breathalyzer measures the concentration of alcohol in the blood by measuring the concentration of alcohol in the breath. However, if the Breathalyzer is not calibrated correctly or has been poorly maintained, its results will be inaccurate. Another factor to consider is how the test is administered. Most officers ask suspects to take a deep breath and blow hard into the machine. This results in air being taken from deep in the lungs where the alcohol concentration may be artificially higher. In cases where someone may in actuality be below .08, deep breaths may result in a reading greater than .08.
